Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Piano Notes Master (the "Service"), operated by Luka Cupic, Fröttmaninger Straße 20A, 80805 München, Germany (contact: lukacstudios@gmail.com).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Accounts

You must provide accurate and complete information when creating an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

Your account is for your personal use only. Sharing your account with others is not permitted.

Each person may only maintain one account. Creating additional accounts to circumvent free-tier limits or access restrictions is a violation of these Terms and may result in termination of all associated accounts.

3. Free Tier and Premium Subscription

Free Tier

Piano Notes Master offers a free tier that includes 2 games in Learn Mode and 2 games in Challenge Mode. No payment is required to access the free tier.

Premium Subscription

A Premium subscription unlocks unlimited games and all features. Subscriptions are billed via PayPal on a recurring basis at the following rates:

  • Monthly: €2.99 per month
  • Yearly: €14.99 per year

All prices are stated in Euro. As a Kleinunternehmer (§ 19 UStG), no VAT is charged.

Your subscription renews automatically at the end of each billing period unless you cancel it beforehand. You can cancel at any time via your PayPal account. Upon cancellation, you retain access until the end of the current billing period.

Payments are processed by PayPal. I do not store your payment details.

4. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from a subscription contract within 14 days of purchase without giving a reason (Widerrufsrecht).

To exercise your right of withdrawal, contact me at lukacstudios@gmail.com within 14 days of your purchase with a clear statement of your decision to withdraw. I will refund the payment promptly and no later than 14 days after receiving your withdrawal.

Please note that by proceeding with the subscription and immediately accessing premium features, you expressly consent to performance beginning before the withdrawal period expires. If you have used premium features and then exercise your right of withdrawal, a proportionate deduction for the service already provided may apply.

5. Intellectual Property

The Service and its content, features, and functionality are the exclusive property of Luka Cupic. The Service is protected by German and international copyright law.

You may not copy, modify, distribute, or create derivative works based on the Service without prior written permission.

6. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Impersonate any person or entity.
  • Attempt to gain unauthorized access to the Service or its infrastructure.
  • Reverse-engineer, decompile, or extract source code from the Service.
  • Create multiple accounts to circumvent free-tier limits or other restrictions.
  • Resell or redistribute access to the Service without written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Luka Cupic shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Nothing in these Terms limits liability for damages caused intentionally or through gross negligence, or for claims under mandatory consumer protection law.

8. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind. I do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

9. Governing Law

These Terms are governed by the laws of Germany. If you are a consumer in the EU, you also benefit from any mandatory protective provisions of the law of your country of residence. Disputes shall be subject to the jurisdiction of the courts of München, Germany, unless mandatory consumer law provides otherwise.

10. Changes to Terms

I may update these Terms from time to time. For material changes, I will provide at least 30 days' notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
